Manny, It will depend upon what type of bankruptcy you filed.A Chapter 7 bankruptcy (liquidation) does not disqualify a borrower from obtaining an FHA mortgage if at least two years have elapsed since the date of the discharge of the bankruptcy. Additionally, you must have re-established good credit or chosen not to incur new credit obligations. You also must have demonstrated a documented ability to responsibly manage your financial affairs. An elapsed period of less than two years, but not less than 12 months, may be acceptable if the you can show that the bankruptcy was caused by extenuating circumstances beyond your control and has since exhibited a documented ability to manage your affairs in a responsible manner. Additionally, the lender must document that the borrower's current situation indicates that the events that led to the bankruptcy are not likely to recur.A Chapter 13 bankruptcy does not disqualify a borrower from obtaining an FHA mortgage provided the lender documents that one year of the payout period under the bankruptcy has elapsed and the borrower's payment performance has been satisfactory (i.e., all required payments made on time). In addition, the borrower must receive permission from the court to enter into the mortgage transaction.Hope this helps.Lynda Sep 12th 2010

You're probably going to have to explain your reasons for filing; since it was a dismissal, you'll probably have to demonstrate that your reasons for filing have been remedied, since your debts were not discharged. Your credit score is good, but factors in your credit file will be reviewed, also; with that score, you're probably okay, though. Sep 12th 2010

Manny, Right now you can. Guidelines are changing often lately. I just got notified by two of our traditional lenders, that effective today they are requiring 7 years from discharge date, instead of 5.FHA is currently at 2 years. But, who knows what tomorrow will bring. .... Happy funding, Rudi Sep 13th 2010 |
