Can one apply for a HARP loan to refiance if they have a bankrupcy less than 3 years old?

Yes and no.. Assuming that your current loan is HARP eligible.. (It must be owned by Fannie or Freddie, and been initiated prior to June, 2009). Then the guidelines do allow for you to refinance using HARP, even with a BK or foreclosure.. But understand that each lender that does HARP loans can add additional guidelines above what the HARP requirements are.. it's these "Overlay's" that makes lending different, one lender to the other.. This is why I always suggest you contact a local mortgage broker vs. a bank.. since brokers have relationships with numerous lenders (I have 21).. then the more lenders, the more lending options, and the greater likelihood your loan scenario will be accepted. Great question Jerry - you will get several answers - Fannie Mae as of 11/15/2011 does not require you to wait the standard period after BK. Many lenders will have their own restriction on this and may not allow it. There are several criteria that need to be met for HARP - if you'd like to call me, I can walk you through them. If your loan is currently owned by Freddie Mac or Fannie Mae (I can help you with that determination) and you have been in that loan since May 31, 2009, then your loan may be eligible for a HARP refinance. HARP does not take bankruptcy or other derogatory credit issues (other than mortgage lates) into consideration for qualifying. Feel free to reach out...I'm happy to help!
