Is this fraud ..... to husband and lender???

Marriage 2010 ...............wife owns property in Georgia before marriage. Last year she refinanced her property. She signed her husband name or somebody signed for him, on the spousal consent form to the lender. Husband NEVER signed the paper and is now hold responsible for payments by lender. She is 3 month behind in payment and makes a new payment just before the lender forecloses. Husband did not know about the situation, till the lender send a letter to him and requested payment. If the form includes the Husband's signature, but the husband did not sign the form, then it would appear that fraud was involved. Joe is correct. Well of course it's fraud.. if the husband never signed, there's no other way for her loan to have go through.. so either he signed and is now saying he didn't, or he actually didn't sign and his signature was forged.. The only exception I can think of is if the wife had a specifi power of attorney to sign for the husband. Definitely talk to a lawyer but it might also be necessary to file a police report regarding fraud... you need legal advice!
